05       BUSINESS ARISING FROM PREVIOUS MINUTES

 

CONSENSUS:

That:

1.         It be noted in the Minutes that the information requested in Item 08  - Business Arising from the Previous Minutes report held on 18 October 2013 had been provided by both Wauchope Rotary Club and Tacking Point Lions Club prior to the November Meeting.

2.         The information contained in Item 10 – Business Arising from the Previous Minutes report held on 18 October 2013 be noted.

 

 

06       2014 Port Macquarie-Hastings Australia Day Awards

CONSENSUS:

 

1.         That the Sub-Committee note the information contained in the 2014 Port Macquarie-Hastings Australia Day Awards report.

2.         All member of the Sub-Committee are to encourage people to forward nominations.

3.         The Mayor and Councillors to encourage community members to view information on the website and put forward nominations.

4.         A suggestion to prepare a brief paragraph of information to be distributed at Growers Market and IGA to encourage more people to get involved.

 

 

07       2014 Australia Day Ambassador Program

CONSENSUS:

 

That the information in the 2014 Australia Day Ambassador report and the verbal update provided at the meeting be noted.

 

 

08       2014 Australia Day Activities Budget

CONSENSUS:

 

That further discussion take place between Council and the representatives of the Laurieton Rotary Club regarding their budget estimate to undertake the Australia Day Activities at Laurieton. 

 

 

09       Australia Day Activities - Wauchope

CONSENSUS:

 

That the information in the Australia Day Activities – Wauchope report be noted.

The update provided by the representatives Wauchope Rotary Club on the activities proposed as part of their Australia Day 2014 celebrations be noted.

 

 

10       Australia Day Activities - Port Macquarie

CONSENSUS:

That :

1.          The information in the Australia Day Activities - Port Macquarie report be noted.

2.          The update provided by the representatives of Tacking Point Lions Club on the activities proposed as part of their Australia Day 2014 celebrations be noted.

3.         The update provided by the Sailability NSW representative be noted. RMS requires additional consultation with key stakeholders.

4.         The update provided by the Community Representative relating to the cadets agreement to conduct the flag raising ceremony be noted.

5.         Consideration be given to the preparation of a site map of the event/precinct and what is available where and when to assist in informing the community what is on. This will be considered.

6.         Confirmation required as to whether there is a Marquee over stage .

 

 

11       Australia Day Activities - Camden Haven

CONSENSUS:

That:

1.         The information in the Australia Day Activities - Camden Haven Report be noted and that the information provided by the representative of the Laurieton Rotary Club be noted.

2.         That Council representatives hold discussions with Laurieton Rotary Club representatives regarding the Australia Day Activities to be staged in the Camden Haven.

3.         Council to contact Robyn Ryan OAM to see what role they can play on the day.

(Local Government Act and Code of Conduct)

 

A conflict of interest exists where a reasonable and informed person would perceive that a Council official could be influenced by a private interest when carrying out their public duty. Interests can be of two types: pecuniary or non-pecuniary.

 

All interests, whether pecuniary or non-pecuniary are required to be fully disclosed and in writing.

 

Pecuniary Interest

 

A pecuniary interest is an interest that a Council official has in a matter because of a reasonable likelihood or expectation of appreciable financial gain or loss to the Council official. (section 442)

 

A Council official will also be taken to have a pecuniary interest in a matter if that Council official’s spouse or de facto partner or a relative of the Council official or a partner or employer of the Council official, or a company or other body of which the Council official, or a nominee, partner or employer of the Council official is a member, has a pecuniary interest in the matter. (section 443)

 

The Council official must not take part in the consideration or voting on the matter and leave and be out of sight of the meeting. (section 451)

 

Non-Pecuniary

 

A non-pecuniary interest is an interest that is private or personal that the Council official has that does not amount to a pecuniary interest as defined in the Act.

 

Non-pecuniary interests commonly arise out of family, or personal relationships, or involvement in sporting, social or other cultural groups and associations and may include an interest of a financial nature.

 

The political views of a Councillor do not constitute a private interest.

 

The management of a non-pecuniary interest will depend on whether or not it is significant.

 

Non Pecuniary – Significant Interest

 

As a general rule, a non-pecuniary conflict of interest will be significant where a matter does not raise a pecuniary interest, but it involves:

(a)   A relationship between a Council official and another person that is particularly close, for example, parent, grandparent, brother, sister, uncle, aunt, nephew, niece, lineal descendant or adopted child of the Council official or of the Council official’s spouse, current or former spouse or partner, de facto or other person living in the same household.

(b)   Other relationships that are particularly close, such as friendships and business relationships. Closeness is defined by the nature of the friendship or business relationship, the frequency of contact and the duration of the friendship or relationship.

(c)   An affiliation between a Council official an organisation, sporting body, club, corporation or association that is particularly strong.

 

If a Council official declares a non-pecuniary significant interest it must be managed in one of two ways:

1.     Remove the source of the conflict, by relinquishing or divesting the interest that creates the conflict, or reallocating the conflicting duties to another Council official.

2.     Have no involvement in the matter, by taking no part in the consideration or voting on the matter and leave and be out of sight of the meeting, as if the provisions in section 451(2) apply.

 

Non Pecuniary – Less than Significant Interest

 

If a Council official has declared a non-pecuniary less than significant interest and it does not require further action, they must provide an explanation of why they consider that the conflict does not require further action in the circumstances.

Important Information

ii.  Section 442 of the Local Government Act 1993 provides that a pecuniary interest is an interest that a person has in a matter because of a reasonable likelihood or expectation of appreciable financial gain or loss to the person. A person does not have a pecuniary interest in a matter if the interest is so remote or insignificant that it could not reasonably be regarded as likely to influence any decision the person might make in relation to the matter or if the interest is of a kind specified in section 448 of that Act (for example, an interest as an elector or as a ratepayer or person liable to pay a charge).

iii.   A pecuniary interest may arise by way of a change of permissible use of land adjoining, adjacent to or in proximity to land in which a councillor or a person, company or body referred to in section 443 (1) (b) or (c) of the Local Government Act 1993 has a proprietary interest—see section 448 (g) (ii) of the Local Government Act 1993.

iv.   Relative is defined by the Local Government Act 1993 as meaning your, your spouse’s or your de facto partner’s parent, grandparent, brother, sister, uncle, aunt, nephew, niece, lineal descendant or adopted child and the spouse or de facto partner of any of those persons.

2.       That the Sub-Committee determine the recipients of the 2014 PMHC Australia Day Awards.

 

 

Discussion

 

Acceptance of nominations for the 2014 Australia Day Awards closed on Friday 29 November 2013.

 

As previously advised, the Australia Day Council of NSW has sent through six (6) nominations that they received for the National Australia Day Awards. These have been included as part of the PMHC 2014 Australia Day Awards.

 

The following number of nominations has been received.

 

·    Young Citizen of the Year -  Five (5) nominations

·    Senior Citizen of the Year  - Four (4) nominations

·    Citizen of the Year - Four (4) nominations

·    Community Group  of the Year - Five (5) nominations

 

Copies of the scanned applications and a Voting Matrix were made available to the Sub-Committee members for collection from Council’s Offices in PMQ on Friday 6 December 2013 to enable time for their perusal and assessment. 

 

Further discussion to be held regarding the marquee to be erected over the staging at this presentation event.

Discussion

Council has now received advice that Judy Stone AM will be the Port Macquarie-Hastings Council Australia Day Ambassador for 2014.

Judy is an Australian pop and country singer from Sydney, who came to national prominence in the late 1950s through her regular TV appearances on the Australian pop music show Brian Henderson's Bandstand and her many hit records.

Council is still awaiting receipt of Judy’s contact details, travel arrangements, biography and photos. Judy’s bio and photos will be used to showcase her profile in our local media in the lead up to Australia Day 2014. Judy’s photo and brief précis will also be included in each of the programs outlining the Australia Day Activities planned for Laurieton, Wauchope and Port Macquarie Australia Day. 

Judy will stay at Rydges Port Macquarie on Saturday 25th and Sunday 26th January with Rydges sponsoring one (1) nights’ accommodation.

That the information provided by Wauchope Rotary Club on their proposed Australia Day celebrations be noted.

 

 

Discussion

 

Wauchope Rotary Club has now submitted all information required by Council in relation to the staging of the 2014 Australia Day Celebrations planned for Bain Park, Wauchope.

 

Council is aiming to have the Section 68 application approved prior to the Christmas/New Year break.

 

Copies of the Risk Assessment provided will be forwarded with Council’s Risk Assessment to Council’s Insurers for notation of the event.

 

Council’s Communications Team is preparing posters promoting the event. Posters will be available for collection from the Communications Team from Monday 6 January 2014. Programs will be available on or before the first meeting for 2014 set down for Friday 17 January 2014 (providing there be no further changes required).   

 

An invitation has been extended to the Mayor’s Executive Assistant to provide an update regarding the possible inclusion of a Citizenship Ceremony and the number of candidates currently in the waiting pool. Should a Citizenship Ceremony take place, an additional car parking space will be required and designated area for candidates to register from 9.45am.

Discussion

 

Tacking Point Lions Club has now submitted all information required by Council in relation to the staging of the 2014 Australia Day Celebrations planned for Town Green, Port Macquarie.

Confirmation yet to be obtained from all the Cadet Organisations regarding the flag raising as part of the official ceremony. Confirmation only received from Air Cadets.

 

As advised at the October meeting, two skydivers will jump over Town Green just prior to the start of the official program at 3.00pm. One skydiver will carry a large Australian Flag the other will carry a large Aboriginal Flag. The drop zone is yet to be confirmed, and will be either Westport Park or Pelican Island. This will need to be discussed further with Coastal Skydivers once the application from Sailability NSW has been approved. Should the drop zone be Pelican Island, a Marine Rescue vessel will be required to retrieve the skydivers and return them to Town Green. The Sub-Committee’s Community Representative is to notify Marine Rescue of the above and confirm at the meeting set down for 17 January 2014, their availability should it be required.

 

Ongoing discussions are continuing with Council’s Aboriginal Community Development & Liaison Officer regarding the possible inclusion of a cultural dance display/cultural workshop and/or market stall as part of the Port Macquarie Australia Day Celebrations. An update will be provided as soon as more information becomes available.
