LOCAL TRAFFIC COMMITTEE CHARTER

1.    Purpose

 

The Local Traffic Committee (LTC) is a technical review committee formed under the NSW Roads & Traffic Authority - “A Guide to the Delegation to councils for the regulation of traffic (including the operation of Traffic Committees) - November 2016”. The committee provides advice on matters referred to it by Council. Council must refer all traffic related matters to the         Local Traffic Committee prior to exercising its delegated functions relating to:

 

a)             Authorisation of prescribed traffic control devices covered under Division 1 of Part 4 (Section 50 to 55) of the Road Transport (Safety and Traffic Management) Act, 1999.

b)             Regulation of traffic under Division 2 of Part 8 (Sections 116 to 119) of the Roads Act, 1993.

c)             Authorisation of special event parking schemes under Division 2 of Part 5 (clause 122 and 123) of the Road Transport (Safety and Traffic Management) (Road Rules) Regulation, 1999.

 

2.    Chairperson

 

The meeting is chaired by the Mayor or Deputy Mayor, if neither representatives are present, the meeting will be chaired by the most senior Council staff representative from the Community Infrastructure Planning and Design team present at the meeting.

 

3.    Membership

 

The LTC is to be made up of four formal members. Each formal member is entitled to vote on matters being considered by the LTC. The members are as follows:

 

a)   One representative of Council,

b)   One representative of the NSW Police;

c)    One representative of the Transport for NSW;

d)   The local State Members of Parliament (MP) or their nominee (noting they may only vote on items within their electorates).

 

If the Mayor or Deputy Mayor are not present for the meeting, Council’s voting position will be delegated to the most Senior Council representative from the Community Infrastructure Planning and Design team.

 

Council may also decide to have additional non-voting informal members of the LTC. f)               One representative of the Ministry Transport;

g)             One representative of the NSW Fire Brigade;

h)             One representative of the NSW Ambulance Service;

i)               One representative of the Transport Workers Union;

j)               One representative of each local Bus operator;

k)             One representative of each local Taxi operator.

 

Informal advisors are only required to attend the LTC when items appear on the agenda which affect their area of expertise or responsibility.

 

4.    Quorum

 

The LTC has no quorum requirement for its meetings. As Council, can only exercise its delegation after seeking the advice of the NSW Police and TfNSW, if a voting delegate cannot attend a meeting, they can be consulted via email or telephone, and their advice will be included in the recommendation of the LTC. As such a meeting can go ahead with any number of voting members as long as all absent members are consulted on each matter.

 

5.    Voting

 

While an organisation, which is a voting member, may choose to have more than one representative, that organisation is still limited to one vote only.

 

In cases where more than one representative from the NSW Police, TfNSW, Local Member or Council is in attendance at the meeting, all representatives can remain during deliberations and voting, however, the NSW Police, TfNSW, Council and Local Member will only be entitled to one vote each. The most senior representative from each organisation will hold the right to vote, the nominated voting person will need to be declared at the commencement of the meeting.

 

As Council, can only exercise its delegation after seeking the advice of the NSW Police, TfNSW and the Local Member, if a voting member cannot attend a meeting, they can be consulted via email and their advice will be included in the recommendation of the LTC and the minutes.

 

In cases of urgency or subject to current public health orders, Council may consult via electronic means with the voting members of the Committee, for the purposes of seeking their advice, without the need for a face-to-face meeting.

 

The advice of the LTC to Council or its Sub-Delegate on a particular matter must be one of the following:

a)        Unanimous support;

a)        Majority support;

b)        Split vote;

c)         Minority support; or

d)        Unanimous decline.


Where the advice of the LTC is not unanimous, the dissenting vote should be named and noted in the recommendation to Council, or its sub delegate.

 

The Chairperson of the LTC does not have a casting vote on any matter considered by the LTC.    

 

If the Council decides to proceed with a proposal where the advice from the LTC is not unanimous support, then the Council must first advise TfNSW and the NSW Police Representatives in writing of their intention to approve the proposal. The TfNSW or the NSW Police may then lodge an appeal to the Regional Traffic Committee. Council must not exercise any of the functions, in relation to the subject proposal, for a period of 14 days from the date of notification in writing.

 

6.    Convenor

 

The Committee shall be convened by the Council voting representative. It shall be the responsibility of the convenor to ensure the conduct of the meeting including voting, informal advisor, public and media participation is undertaking in accordance with the TfNSW. Guidelines.

 

7.    Meeting Formats

 

Council’s Community Infrastructure Planning and Design team are responsible for the co-ordination of Committee advice, scheduling of meetings, preparation and circulation of meeting minutes, and provide general support services to the Committee. The Community Infrastructure Planning and Design team is also responsible for providing advice in relation to the conduct of meetings.

 

The most common format for LTC meetings is regular face to face meeting held in the offices of the Council.

 

Acceptable alternative meeting formats include:

·                Electronic meetings - where the advice of the members is sought via email or via

                                       virtual meeting.

·                A combination of electronic and face to face meetings

 

a)        Agendas, minutes, and reports

 

All meetings require the preparation of an agenda. An agenda must be pre prepared by Council and circulated to all formal members and informal advisors of the Committee a minimum of one week prior to the meeting.

 

For each agenda item, Council must prepare a report which must contain a brief summary of the issue, detail of the proposed solution including a plan if the proposal involves signs, lines or structures, details of the policies.

 

Urgent out of session items can be circulated to all formal members and informal advisors of the Committee for consideration and comment. Votes will be recorded via email and tabled at the next meeting to be formally recorded and adopted as a General Business item.


 

All meetings require a written record of proceedings in the form of formal Minutes. The minutes must be prepared by Council and circulated to all formal members and informal advisors of the Committee within two weeks of the meeting being held. The LTC minutes will be presented at the next Ordinary Council meeting for endorsement.

 

b)       Site visits

 

It is recommended that each member of the LTC undertake a site visit prior to considering any proposal. This site visit may be undertaken individually or as an organised joint visit.

 

 

8.    Delegations

 

Council has delegations to authorise traffic control facilities and devices as prescribed in the Delegations to Councils – Regulation of Traffic October 2001.

 

Council has sub-delegated its powers in respect of Division 1 of Part 4 of the Road Transport (Safety and Traffic Management) Act 1999 and Division 2 of Part 5 of the Road Transport (Safety and Traffic Management) (Road Rules) Regulation 1999 to the Director of Infrastructure Services and the Technical Services Manager.

07 Ironman 2024 Proposed Course Changes

CONSENSUS:

That the Local Traffic Committee noted the Ironman 2024 Traffic Management Plan to be finalised and be reported to the March 2024 Local Traffic Committee meeting.

 

King Creek Road Temporary Closure - Bridge Replacement

CONSENSUS:

Council advised of a delay in works and the resultant road closure due to ongoing land ownership discussions. Council committed to advise the Local Traffic Committee and Busways of the amended date of closure as soon as known. Busways advised of a need of 3 to 4 weeks advanced notice in order to obtain TfNSW alternate route approval and to notify patrons.

 

12.01 Ocean Drive Bus Stops

CONSENSUS:

TfNSW attended site to inspect, unfortunately it was during the school holidays and need to be revisited during school operation time.

 

12.02 Lake Cathie Speed Reduction

CONSENSUS:

TfNSW attended site to inspect, unfortunately it was during the school holidays and need to be revisited during school operation time. 

TfNSW are commencing a speed zone review which will investigate moving the current 50 km/hr zone southwards to cover the intersection with Solomon Drive. Council and NSW Police support the proposed change.

 

12.03 NSW Senior Touch Football

CONSENSUS:

A copy of the approved Traffic Management Plan/Guidance Scheme for the event was circulated to the Local Traffic Committee as previously requested.

 

12.05 Event Reports with Extensive Conditions

Addressed via report 07 below.

 

 

06       2024 Port Macquarie Running Festival

CONSENSUS:

 

That it be a recommendation to the Director Community Infrastructure, under sub delegation, for implementation:

 

That Council approve the temporary road closures and support the associated transport management arrangements associated with the 2024 Port Macquarie Running Festival on 2 and 3 March 2024, subject to the following conditions:

 

1.   That the event organiser advertises, at no cost to Council, provide the following details of all temporary road closures and temporary parking restrictions associated with this event in the local print media on separate days, at least twice (2) within 14 days prior to the event:

·      temporary road closure location, times and duration

·      temporary parking restriction location, times and duration

·      alternative routes and access arrangements.

2.   That the event organiser advertises the event by undertaking a letter box drop to all residents and businesses directly affected by the temporary road closures and temporary parking restrictions at least 14 days prior to the event, advising the following:

·      event name

·      event times

·      contact details of at least two (2) people involved in the organisation of the event, in case of an emergency

·      proposed actions to be undertaken to mitigate the impact of the temporary road closures and temporary parking restrictions.

3.   That the Traffic Management Plan (TMP) be implemented. Any modifications to the plans must be agreed with Council prior to the running of the event.

4.   That the event organiser abides by the written approval from the NSW Police.

5.   That the event organiser notifies the NSW Ambulance, NSW Fire & Rescue, NSW Rural Fire Service and the State Emergency Service of the proposed road closures at least 14 days in advance of the event.

6.   That the event organiser notifies local Transport Services (Bus Companies, Taxis) of the proposed road closures at least 14 days in advance of the event and assists in developing alternatives for affected users.

7.   TfNSW/SafeWork NSW accredited persons (Implement Traffic Control Plans) are to be used for the establishment and removal of the traffic control devices.

8.   TfNSW/SafeWork NSW accredited traffic controllers (Traffic Controller) are to be used to control traffic.

9.   That the event organiser abides by any other condition that Council or NSW Police may impose at any time.

10. That the event organiser submits to Council 14 days prior to the commencement of the event evidence of Public Liability Insurance for the amount of $20 million, which is valid for the duration of the event, including placement and removal of traffic control devices.

11. The event organiser must have this approval and the Traffic Management Plan described above on site at all times for the duration of the event.

12. That a review of the implementation of the Traffic Management Plan (TMP) be undertaken by the proponent within three months of the conclusion of the event. The review is to be in consultation with Council and other services so that the TMP can be further refined and any issues identified can be addressed prior to any future events.

07       EVENT REPORTS WITH EXTENSIVE CONDITIONS

CONCENSUS:

 

That the Local Traffic Committee:

1.       Noted the proposed change to report formatting regarding the conditions relating to events and other road closures.

2.       Provide any feedback to Council on the proposed format prior to 23 February 2024 to enable implementation of the updated measures from March 2024 onwards.

08       GENERAL BUSINESS

08.01 SOUTHERN ARM TRUNK MAIN - HOUSTON MITCHELL DRIVE

 

DISCUSSION:

The Community Utilities (Water and Sewer) division is initiating the construction of a water delivery pipeline project along Houston Mitchell Drive. Over the course of this 12-month project, one traffic lane will undergo temporary and intermittent closure. In order to facilitate traffic management, a traffic management plan will be implemented, allowing for incremental movements as the construction progresses.

Expressing concerns about potential impacts on traffic volume, the Mayor inquired about monitoring efforts. Furthermore, the Mayor sought information on the preparedness of Radio, TV, and Social Media communications given the projects duration and the substantial number of community members who utilise the road.

A written update request has been made to ensure the Bonny Hills Progress Association is informed if not already provided with information. Additionally, questions have been raised about the length of the contraflow system and its potential effects on the overall duration of delays. A copy of the Traffic Management Scheme for the works will be shared with the committee.

 

08.02 FERNBANK CREEK ROAD SPEED REDUCTION ASSESSMENT

 

DISCUSSION:

 

A request for an update from the Transport for NSW (TfNSW) representative regarding the status of the speed reduction assessment for Fernbank Creek Rd was tabled.

TfNSW advised that the assessment has been finalised and is presently advancing through the TfNSW internal procedures.

Busways raised concern about drivers utilising the dirt section of the road reserve at the junction of Fernbank Creek Road and Hastings River Drive. This behaviour may involve insufficient deceleration to navigate the corner or pose a line-of-sight issue.

Action that the Local Traffic Committee request Council to look into the concerns regarding drivers using the dirt section of the road reserve at the intersection of Fernbank Creek Road and Hastings River Drive and any corrective actions that could be implemented in response to these concerns.

Pecuniary Interest

 

4.1         A pecuniary interest is an interest that you have in a matter because of a reasonable likelihood or expectation of appreciable financial gain or loss to you or a person referred to in clause 4.3.

4.2         You will not have a pecuniary interest in a matter if the interest is so remote or insignificant that it could not reasonably be regarded as likely to influence any decision you might make in relation to the matter, or if the interest is of a kind specified in clause 4.6.

4.3         For the purposes of this Part, you will have a pecuniary interest in a matter if the pecuniary interest is:

(a)   your interest, or

(b)   the interest of your spouse or de facto partner, your relative, or your partner or employer, or

(c)   a company or other body of which you, or your nominee, partner or employer, is a shareholder or member.

4.4         For the purposes of clause 4.3:

(a)   Your “relative” is any of the following:

i)     your parent, grandparent, brother, sister, uncle, aunt, nephew, niece, lineal descendant or adopted child

ii)    your spouse’s or de facto partner’s parent, grandparent, brother, sister, uncle, aunt, nephew, niece, lineal descendant or adopted child

iii)    the spouse or de facto partner of a person referred to in paragraphs (i) and (i)

(b)   “de facto partner” has the same meaning as defined in section 21C of the Interpretation Act 1987.

4.5         You will not have a pecuniary interest in relation to a person referred to in subclauses 4.3(b) or (c)

(a)   if you are unaware of the relevant pecuniary interest of your spouse, de facto partner, relative, partner, employer or company or other body, or

(b)   just because the person is a member of, or is employed by, a council or a statutory body, or is employed by the Crown, or

(c)   just because the person is a member of, or a delegate of a council to, a company or other body that has a pecuniary interest in the matter, so long as the person has no beneficial interest in any shares of the company or body.

 

Non-Pecuniary

 

5.1         Non-pecuniary interests are private or personal interests a council official has that do not amount to a pecuniary interest as defined in clause 4.1 of this code. These commonly arise out of family or personal relationships, or out of involvement in sporting, social, religious or other cultural groups and associations, and may include an interest of a financial nature.

5.2         A non-pecuniary conflict of interest exists where a reasonable and informed person would perceive that you could be influenced by a private interest when carrying out your official functions in relation to a matter.

5.3         The personal or political views of a council official do not constitute a private interest for the purposes of clause 5.2.

5.4         Non-pecuniary conflicts of interest must be identified and appropriately managed to uphold community confidence in the probity of council decision-making. The onus is on you to identify any non-pecuniary conflict of interest you may have in matters that you deal with, to disclose the interest fully and in writing, and to take appropriate action to manage the conflict in accordance with this code.

5.5         When considering whether or not you have a non-pecuniary conflict of interest in a matter you are dealing with, it is always important to think about how others would view your situation.

Managing non-pecuniary conflicts of interest

5.6         Where you have a non-pecuniary conflict of interest in a matter for the purposes of clause 5.2, you must disclose the relevant private interest you have in relation to the matter fully and in writing as soon as practicable after becoming aware of the non-pecuniary conflict of interest and on each occasion on which the non-pecuniary conflict of interest arises in relation to the matter. In the case of members of council staff other than the Chief Executive Officer, such a disclosure is to be made to the staff member’s manager. In the case of the Chief Executive Officer, such a disclosure is to be made to the mayor.

5.7         If a disclosure is made at a council or committee meeting, both the disclosure and the nature of the interest must be recorded in the minutes on each occasion on which the non-pecuniary conflict of interest arises. This disclosure constitutes disclosure in writing for the purposes of clause 5.6.

5.8         How you manage a non-pecuniary conflict of interest will depend on whether or not it is significant.

5.9         As a general rule, a non-pecuniary conflict of interest will be significant where it does not involve a pecuniary interest for the purposes of clause 4.1, but it involves:

a)    a relationship between a council official and another person who is affected by a decision or a matter under consideration that is particularly close, such as a current or former spouse or de facto partner, a relative for the purposes of clause 4.4 or another person from the council official’s extended family that the council official has a close personal relationship with, or another person living in the same household

b)    other relationships with persons who are affected by a decision or a matter under consideration that are particularly close, such as friendships and business relationships. Closeness is defined by the nature of the friendship or business relationship, the frequency of contact and the duration of the friendship or relationship.

c)    an affiliation between the council official and an organisation (such as a sporting body, club, religious, cultural or charitable organisation, corporation or association) that is affected by a decision or a matter under consideration that is particularly strong. The strength of a council official’s affiliation with an organisation is to be determined by the extent to which they actively participate in the management, administration or other activities of the organisation.

d)    membership, as the council’s representative, of the board or management committee of an organisation that is affected by a decision or a matter under consideration, in circumstances where the interests of the council and the organisation are potentially in conflict in relation to the particular matter

e)    a financial interest (other than an interest of a type referred to in clause 4.6) that is not a pecuniary interest for the purposes of clause 4.1

f)     the conferral or loss of a personal benefit other than one conferred or lost as a member of the community or a broader class of people affected by a decision.

5.10       Significant non-pecuniary conflicts of interest must be managed in one of two ways:

a)    by not participating in consideration of, or decision making in relation to, the matter in which you have the significant non-pecuniary conflict of interest and the matter being allocated to another person for consideration or determination, or

b)    if the significant non-pecuniary conflict of interest arises in relation to a matter under consideration at a council or committee meeting, by managing the conflict of interest as if you had a pecuniary interest in the matter by complying with clauses 4.28 and 4.29.

5.11       If you determine that you have a non-pecuniary conflict of interest in a matter that is not significant and does not require further action, when disclosing the interest you must also explain in writing why you consider that the non-pecuniary conflict of interest is not significant and does not require further action in the circumstances.

5.12       If you are a member of staff of council other than the Chief Executive Officer, the decision on which option should be taken to manage a non-pecuniary conflict of interest must be made in consultation with and at the direction of your manager. In the case of the Chief Executive Officer, the decision on which option should be taken to manage a non-pecuniary conflict of interest must be made in consultation with and at the direction of the mayor.

5.13       Despite clause 5.10(b), a councillor who has a significant non-pecuniary conflict of interest in a matter, may participate in a decision to delegate consideration of the matter in question to another body or person.

Lake Cathie Speed Reduction

Action Required:

Port Macquarie Taxis noted that development and traffic around Houston Mitchell Drive in Lake Cathie has increase traffic and potential for incident (Construction of a new Ambulance Station and Aged Residential Development). It was suggested that a speed zone reduction from 70kph to 50kph should be considered in this vicinity.

 

Speed Zone Reviews are undertaken by TfNSW.

Council is in discussions with TfNSW regarding a speed zone review at this location.

Update:

TfNSW attended site to inspect, unfortunately it was during the School Holidays and will need to revisit during School time.

TfNSW are commencing a speed zone review which will investigate moving the current 50 km/hr zone southwards to cover the intersection with Solomon Drive. Council and Police support the proposed change.

Council are presently preparing a quotation for the installation of the signage and linemarking as required to support this change.

08.02 FERNBANK CREEK ROAD SPEED REDUCTION ASSESSMENT

A request for an update from the Transport for NSW (TfNSW) representative regarding the status of the speed reduction assessment for Fernbank Creek Rd was tabled.

 

TfNSW advised that the assessment has been finalised and is presently advancing through the TfNSW internal procedures.

 

Busways raised concern about drivers utilising the dirt section of the road reserve at the junction of Fernbank Creek Road and Hastings River Drive. This behaviour may involve insufficient deceleration to navigate the corner or pose a line-of-sight issue.

 

Action that the Local Traffic Committee request Council to look into the concerns regarding drivers using the dirt section of the road reserve at the intersection of Fernbank Creek Road and Hastings River Drive and any corrective actions that could be implemented in response to these concerns.

 

Update:

Council investigation into the intersection usage is ongoing. Outcome to be reported to May 2024 committee.

That the Committee consider advice to be provided at the meeting on community engagement undertaken with respect to the bike course in Lake Cathie ahead of consideration of the recommendation below.

That it be a recommendation to the Director Community Infrastructure, under sub-delegation, for implementation:

 

That Council approve the temporary road closures and support the associated transport management arrangements associated with the 2024 Ironman Australia event on Sunday, 5 May 2024, subject to conditions contained within the attached Draft Section 138 Approval Certificate.

 

Executive Summary

 

At the November 2023 Local Traffic Committee Meeting, Council presented detail of the proposed course for the 2024 Port Macquarie IRONMAN event to the Committee for information.

 

Noting that a detailed Traffic Management Plan was not available at that time, the report presented to November 2023 was for information only, with an outcome being that a formal report on the event and the related traffic and parking implications would be submitted for consideration in January 2024 following the submission of an updated Traffic Management Plan for the event, which was due mid December 2023.

 

Since that time, further minor course changes have been proposed in response to a range of circumstances previously unknown to the Ironman Organisers including:

·    the status of Port Macquarie - Hastings Council’s upgrade of Ocean Drive expected at the time of the event,

·    the unavailability of suitable insurance to cover the use of the Remondis tip access road at Telegraph Point, and

·    uncertainties around the status of the Port Macquarie Breakwall upgrade project, which has resulted in some minor changes to the run leg route.

 

An updated Traffic Management Plan and Traffic Guidance Scheme has been provided to Council in late February 2024 (attached) and is now presented for formal review and consideration by the Committee.

 

Discussion

 

The 2024 Port Macquarie Ironman event is an annual event consisting of two separate events held on 5 May 2024, being:


 

·     Ironman 70.3 Port Macquarie event involving approximately 1,500 competitors, male and female, progressively racing a 1.9km swim (Hastings River), 90km bike (out and back course including following the Pacific Coast/Ocean Drive) and a 21.1km run (over 2 laps including various Port Macquarie local streets), and

 

·     Ironman Australia event involving approximately 1,700 competitors, male and female, progressively racing a 3.8km swim (Hastings River), 180km cycle (over 2 laps of a northern course including various Port Macquarie, Blackmans Point, Telegraph Point, Pembrooke roads and one lap of a southern course taking in Port Macquarie and Lake Cathie) and a 42.2km run (over 4 laps including various Port Macquarie local streets).

 

Competitors will progressively finish between approximately 10:08am Sunday (70.3) and 12.35am Monday (IM). The swim leg for all competitors will be completed by 9:55am and the bike leg by 5:35pm. Refer to attachments for the course maps.

 

The event involves the closure of many roads, pathways, car parks, and boat ramps. All of which have been previously recommended for closure by the Local Traffic Committee as part of prior years’ events and subsequently approved by Council. For reference all closures including bus route changes are outlined in the attachments to this report.

 

For reference the Course Maps, Traffic Management Plan (TMP), Traffic Guidance Schemes (TGS), Road Impact Summary, VMS Board Details and Course Times are included as attachments.

 

The Ironman event organisers in conjunction with Council’s Events team will be responsible for advertising and communicating the events and proposed changes for 2024 with the public and all affected stakeholders, including nearby businesses to ensure that all changes are clearly articulated.

 

Roads

 

The Traffic Management Plan (TMP) and Guidance Schemes (TGS) indicate that the following roads on the bike and run course will be closed (either whole road or part of the road):

Roads on the bike course will be progressively closed on 5 May 2024, at the discretion of the Race Director and Police, from approximately 3:30am in Port Macquarie until 7:00am in Lake Cathie and Telegraph Point/Pembrooke Road.

 

Barricades are to be placed from as early as 3:30am on 5 May 2024 but traffic controllers will use discretion to allow movement of traffic until race participants begin arriving at the traffic control locations along the course. All residents with driveways on course will be consulted as outlined in section 4.1 of the detailed TMP attached.

Roads will be progressively reopened once the last competitor has passed through, or a designated cut-off time has been reached. The reopening plan is outlined in section 3.10 of the TMP, and further details can be found in the attached Road Impact Summary attachment.

 

Pathways

 

The following pathways on or adjacent to the run course will be closed:

·     Breakwall Town Green - Town Beach

·     Sunset Parade

·     Town Green

·     Buller Street bridge

·     Westport Park foreshore

·     Park Street

 

Bus Routes

 

Busways services will be altered on Sunday, 5 May 2023, affected services and diversion routes are included in attached TMP under section 3.3.1.

 

Busways has been approached for cooperation to vary their bus routes for Lake Cathie, Port CBD, Matthew Flinders Drive and Settlement Point. There are several services affected, however, it is not expected to cause any significant disruption for the community.

 

Hastings River Ferry

 

The Settlement Point Ferry across the Hastings River will be closed on Sunday, 5 May 2024, however the Hibbard Ferry will operate as normal.

 

Car Parks

 

The Town Square car park will be closed for the period of 11:00pm Monday 29 April until 8:00pm Tuesday 7 May 2024.

 

A part closure of the Westport Boat Ramp car park is proposed from Wednesday 24 April 1:00am, after which the full carpark will be closed from 1:00pm on Saturday 4 May 2024. Following the event the re-opening of the Westport Boat Ramp Carpark will again be phased, with the bottom half (boat ramp) re opening from 5:00pm Monday 6 May, and the remainder of the carpark being opened from 11:59pm Friday 10 May 2024.

 

All other car parks on the bike and run course will be closed progressively and as detailed in Appendix 5.3 of the Traffic Management Plan.

Boat Ramps

 

A detailed breakdown of impacts to boat ramps is outlined in the attached Road Impact Summary.

 

Course Changes for 2024

 

The 2024 Ironman Australia Triathlon includes several of the preliminary proposed changes to the bike and run course that have previously been raised for awareness with the Local Traffic Committee, most recently via an update report presented in November 2023.

 

Furthermore, it is understood that Ironman Organisers have been liaising separately with Council staff, local Police, and transport operators, plus Transport for NSW on the proposed course changes for the 2024 event.

 

The most significant changes to the 2024 event are detailed below. The current proposal includes the following:

 

1.    Swim – no change to 2023.

2.    Bike

a.    The southern turnaround point has been relocated from the intersection of Ocean Drive and Dirah Street (northern extent of Lake Cathie) to a new location approximately 3km south, just to the north of the entry to the Lake Cathie Medical Centre (north of Abel Tasman Drive).

This additional length of bike route is shown by the blue line on the Nearmap (2024)

The above change occurred after the November 2023 Local Traffic Committee meeting and is a response to the following course issues:

 

i.     the unavailability of the Remondis Tip Access Road at Telegraph Point (due to an inability to gain insurance to cover the use of that road), and

ii.     the unavailability of Ocean Drive between Matthew Flinders Drive and Pacific Drive due to the status of the ongoing Ocean Drive Duplication works and temporary traffic management requirements for access needs during the event.

 

In identifying and selecting this option, Ironman organisers did investigate the possibility of extending the bike course further east along Redbank Road, similarly to 2023, however did not pursue this option on the basis that the road surface in that location was a source of complaint from competitors in 2023.

 

In managing the impacts of this course extension, the attached Traffic Management Plan and Guidance Schemes include provisions for detours and the provision of continued access/egress to several residents of the Lake Cathie community and emergency arrangements. See the attached traffic Management Plan for specific details. Ocean Drive within Lake Cathie is anticipated to reopen at 5:30pm as outlined within the plan.

 

A notice has been sent to residents within Lake Cathie with respect the proposed course route (notice attached). The outcome of this engagement will be presented to the Committee at the meeting for information ahead of consideration of the recommendation.

 

b.... As advised in November 2023, both sides of the Blackmans Point Interchange are proposed to be closed for 2024.

 

In this regard, for 2024, after completing the northern end of the course, riders will be turned around for a second lap of the north extents near The Big Oyster on Hastings River Drive. This change will remove the need to use any part of Redbank Road, which as noted above, was a source of complaint from competitors of the 2023 event.

 

c.... As noted in point 2a) above and in difference to the November 2023 report, the Remondis tip access road will not be utilised for 2024. This is a result of the organiser being unable to obtain appropriate insurance to manage the risks associated with the use of this facility.

 

d.... Use of Winery Drive for two laps of the course rather than one lap in the May 2023 race. This change is due to the road being in a condition identified as likely to improve the racing experience (i.e smooth asphalt is desirable for competitors).

 

3.   Run

a... The northern turning point for the run leg has been shifted southwards for 2024. This differs to the prior advice provided in November 2023. In this regard, the run leg for 2024 is shown by the image below, with the prior northern turn around point labelled for comparison:

 

 

b.. In addition to the above, the new run course includes a new loop into the Kooloonbung Creek reserve, and minor changes to the route through the CBD and town beach precinct mean that the amended run course will not use any part of the road network to the east of Town Green (road shoulder to be used). This change will result in reduce traffic impacts on this area of town once the bike course roads are reopened to the public at approximately 6.30pm.

Summary

 

The event is materially similar to previous years regarding the approvals. The course changes summarised above and as attached have undergone extensive consultation with Council, Police and TfNSW.

 

This report is provided to the Local Traffic Committee for further discussion and to formalise the approval process.

IRONMAN is forecast to provide an economic benefit to the Port Macquarie LGA in the value of $14-16million​ and is run at a cost to Council of approximately $292,000 (2023 event).

Introduction

This report aims to seek approval for the road closures associated with the range of local commemorative services coordinated and held by local RSL clubs for events including ANZAC day, VP Day (Victory in the Pacific), Vietnam Veteran’s Day, the 9/11 commemoration service and Remembrance Day, to be held between 2024 and 2028 (inclusive).

These events are important for honouring the sacrifices and contributions of our veterans and allies, as well as promoting peace and unity among our community.

Road closures as detailed within the attached Traffic Management Plans and as outlined in further detail below are necessary to ensure the safety and accessibility of the participants and attendees, as well as facilitating the smooth running of the ceremonies and parades.

Please see below and attached for details on the proposed dates, times, locations and impacts of the road closures.

The report will also outline the consultation process to be followed and will demonstrate that the road closures are justified, reasonable and in the public interest.

Event details and Proposed Road Closures

Port Macquarie RSL

Following recent and ongoing discussions with Port Macquarie RSL, an application has been received for road closures within the Port Macquarie CBD associated with ANZAC day, VP Day (Victory in the Pacific), Vietnam Veteran’s Day, the 9/11 commemoration service, and Remembrance Day.

Details of each event and associated road and traffic impacts are detailed within the attached Traffic Management Plan, with the event specifics summarised below:

·    ANZAC DAY

 

The attached traffic management plan provides the following details of the event:

Dawn Service Commencing at 5:30am in the Town Square adjacent to the cenotaph.

To facilitate the Dawn Service, Clarence Street will be closed at 9:00pm on 24 April from Hay Street through to the U-turn Bay on the western side of the Clarence and Horton Street Intersection.

This closure remains in place until the completion of the morning service at approximately 11:00am on 25 April.

Town Square is proposed to be closed from 4:00pm on 24 April, reopening after the morning service by 12:00pm on 25 April.

The March commences at 10:00am, with marshalling of the parade to commence prior from 09:30am. The March takes approximately 30minutes.

Just prior to 10:00am on 25th April, Horton Street is proposed to be closed from Hayward Street through to the Town Square to facilitate the March, and will be re-opened once complete at 10:30am.

A Morning Service commences at the completion of the March at 10:30am, with the service being completed by approximately 11:15am.

 

Alternate routes, pre-event signage and detour information associated with the above temporary closures are detailed in the Traffic Management plan.

 

·    VP Day (Victory in the Pacific), Vietnam Veteran’s Day, the 9/11 commemoration service and Remembrance Day

The other commemorative events listed above have been historically subject to lower patronage, and hence have been grouped for the purpose of this assessment.

 

Port Macquarie RSL proposes to limit the extent of road and traffic impact for these other events to the Port Macquarie Town Square only, with the full closure of Horton St north of Clarence St intersection proposed for each. Closure will occur between 6:00am and 11:30am for these events.

 

Details of the locations of the temporary closures and traffic impacts during these events are detailed on the image below:

Wauchope RSL

Following recent and ongoing discussions with Wauchope RSL, an application has been received for road closures within the Wauchope CBD associated with ANZAC day only. Unlike Port Macquarie RSL, further closures associated with other commemorative events has not been sought.

Details of the event and associated road and traffic impacts are detailed within the attached Traffic Management Plan and are summarised below:

·    ANZAC DAY

March 1

The first March commences at 5:30am adjacent to Wauchope RSL on Young Street. The parade travels west along Young Street, left into Bransdon Street and proceeds until it turns right onto the Oxley Highway, before assembling at the Cenotaph near the Port Macquarie – Hastings Council Wauchope Office.

The Dawn Services commences at the completion of the march and once the parade has assembled. The service lasts for approximately 30 minutes.

Following completion of the Dawn Service, the return march commences, proceeding east along the Oxley Highway, turns left into Bransdon Street, proceeds until turning right into Young Street and into the Wauchope RSL Car Park concluding at approximately 6:20am.

Road closures for March 1 as identified within the Traffic Management Plan are planned to be implemented between 5:00 and 6:30am

March 2

The second March commences at 1000 following the same route to the Cenotaph near the PMHC Wauchope Offices.

Road closures as identified within the Traffic Management Plan are planned to be implemented by 9:30am

The Morning Service commences at the completion of the march and lasts for approximately 50 minutes at which point the return march commences.

The return march proceeds east along the Oxley Highway, turns left into Hastings Street, proceeds until turning right into Young Street and into the Wauchope RSL Car Park concluding at approximately 12:20pm.

 

Road closures for March 2 as identified within the Traffic Management Plan are planned to be implemented between 9:30am and 12:30pm

Laurieton RSL

Following recent and ongoing discussions with Laurieton RSL, and application has been received for road closures within the Port Macquarie CBD associated with ANZAC day only. Unlike Port Macquarie RSL, further closures associated with other commemorative events has not been sought.

Details of the event and associated road and traffic impacts are detailed within the attached Traffic Management Plan and are summarised below:

·    ANZAC DAY

The attached traffic management plan provides the following details of the event.

A March and Commemorative Service are held in Laurieton each year, with the march commencing at 10:45am in Seymour Street adjacent to the Laurieton Unites Services Club, travelling west along Seymour Street, right into Bold Street through to Kew Road and then into the Laurie Memorial Park, concluding at the Cenotaph.

The March takes approximately 20 minutes.

The Morning Service commences at the completion of the March once the parade has assembled at 11:00am. The commemoration service is completed at approximately 11:45am.

Road closures associated with the March and service and as detailed in the Traffic Management plan occur between 10:30am and 12:00pm or until crowds have dispersed.

Note – the to minimise the impact on traffic through Laurieton, closed road signage and associated controls are relocated to Seymour and Bold Streets once marchers have passed. This enables vehicles to detour the location via Lake Street.

Kendall RSL

Following recent and ongoing discussions with Kendall RSL, and application has been received for road closures within the Port Macquarie CBD associated with ANZAC day commemorative service only. Unlike Port Macquarie RSL, further closures associated with other commemorative events has not been sought.

Details of the event and associated road and traffic impacts are detailed within the attached Traffic Management Plan and are summarised below:

Discussion

The abovementioned events generally follow the same format each year, with no/minimal changes as a result of the relatively fixed nature of the cenotaph infrastructure and parade start/end points at each location.

With respect to Port Macquarie and for those events other than ANZAC Day that draw smaller crowds historically, the RSL had historically sought to seek the closure of a small number of car parking spaces near the cenotaph for those events only. During the 2023 Remembrance Day Event, an unexpectedly large crowd assembled, resulting in the RSL members and traffic controllers being unable to contain attendees within the designated area.

In order to minimise the risks associated with a repeat occurrence and in recognition of the importance of these events to the community, Council has encouraged the Port Macquarie RSL to plan for the full closure of Town Square for each event to minimise the risks associated with larger than anticipated numbers of attendees via the provision of increased capacity.

Council seeks the Local Traffic Committee’s endorsement of the issuing of an ongoing five (5) year event approval for each of the above-mentioned commemorative events to reduce the administrative burden for all associated parties.

Copies of the draft conditions of approval are attached, however please note the following key inclusions:

1.       the event approval being granted on condition the event format and associated community disruption remains functionally unchanged, or if functionally different, to submit a new event application in full as per standard procedures, and

2.       requirements for event notifications to be provided to the LTC, and

3.       Council and Transport for NSW are still able revoke any approvals if necessary, and

4.       The applicant (each RSL) is responsible for undertaking consultation with both businesses, residents and landowners and local transport operators and emergency services to advise of the event specifics and resulting road and traffic impacts of each in accordance with established timeframes.

RECOMMENDATION

 

That it be a recommendation to the Director Community Infrastructure, under sub delegation, for implementation:

 

1.   That Council approve the temporary traffic management arrangements associated with the 2024 Port Macquarie Cycle Club, Winter Road Racing Program, being every Saturday from March to October 2024 (2pm - 6 pm) in addition to a number of further as yet defined events along the same route and times, subject the conditions included within the attached Draft Approval document titled "DRAFT Certificate of Approval - Port Macquarie Cycle Club 2024”

 

The Road Racing Program

The Port Macquarie Cycle Club (PMCC) has been operating in the Hastings region for 33 years and has members aged between 8 and 82 years.

The PMCC has been conducting road races on Saturday afternoons in winter for several years, with events typically involving between 20 and 40 riders incorporating junior, women's and open senior competitors.

On rare occasions rider numbers can exceed 40, however these would never be competing at the same time but would be spread over the course of the day in groups of 10 (approx.).

In addition to the regular Saturday Races, the PMCC hosts the Port Macquarie Junior Tour one weekend in May/June (date yet to be confirmed) of each year, with similar numbers of attendees.

Furthermore, on occasions the Club may reschedule a Saturday Race to a Sunday. This usually will occur due to a Saturday race being cancelled due to weather or because one of the neighbourhood sporting clubs was conducting a major event on the Saturday.

For all events, Cyclists meet in the car park of the Port Macquarie Cycle Club track on Burrawan Forest Rd. The Cycling Club has facilities for a meeting point/ registration area that enables cars to be parked well off the road and not cause any hindrance to traffic or safety.

Competitors typically 'sign on' between 1 pm and 2.30 pm with racing starting between 1.30 pm and 2.30 pm. Final riders are expected to have completed the course by 4:30pm.

Details of each race’s specific details are included within the attached Traffic Management Plan, however for each event, riders are typically split into grades or handicapped, starting in groups of up to 10, at 2 - 5-min intervals.

Races vary in length and number of laps depending on the age and grading of the competitors. The maximum race length is 6 laps at 70 kilometres in total.

The minimum race distance is ridden by junior competitors, consisting of two shortened laps, totalling 12 kilometres. Occasionally races will finish in the opposite direction to that indicated on the course maps, but at the same Start/Finish line.

Traffic Management

Attached to this report are copies of the supplied Traffic Management Plan (TMP)  and Traffic Guidance Schemes (TGS) for the events.

These plans will be implemented and monitored by qualified traffic controllers.

NOTE: There are no road closures proposed, rather motorists will be advised that cyclists will be on the road via signage and may be temporarily stopped by certified traffic controllers using a Stop/Slow bat where indicated.

As background information, the TMP notes that the section of Burrawan Forest Drive that the PMCC uses for these events has no specific destination and few residential driveways, meaning that the racing has historically been found to have minimal impact on traffic.

The applicant has noted that based on prior events, the observed primary reason for vehicles to be on the nominated section of road on Saturday afternoons has historically been observed to be to attend events at the nearby Go-Kart track or by members of the Motocross Club and or Archery Club.

In preparing this TMP and planning for the events, PMCC have liaised with these adjacent organisations to advise of the cycle racing schedule and special events. All groups are reported to be supportive of the cycle racing and have historically advised their members as such and to take care on the identified section of road.

Proposed Event Approval

Given the range of events and durations proposed and the potential for the addition of presently unscheduled events, Port Macquarie - Hastings Council propose to provide the PMCC with a 12 month approval for the use of Burrawan Forest Dr for events as described in the associated TMP, subject to the imposition of all applicable conditions as contained in Council’s standard s138 approval for events on Road Reserves, plus specific requirements that:

1.    Port Macquarie - Hastings Council and Emergency Services (Fire, RFS, Ambulance, Police & SES) are advised of the dates of specific events a minimum of 2 weeks prior to the event, and that

2.    Neighbouring sporting clubs be advised of the dates of specific events a minimum of 2 weeks prior to the event.

Please also note that our standard conditions additionally require print media event notification prior to the event for the benefit of the wider community.

Subject:     Ride the Wave Festival: 2-6 April 2024

RECOMMENDATION

 

That the Local Traffic Committee note the proposed upcoming temporary closure of Alban Place associated with the 2024 Ride the Wave Festival and the associated Traffic Management Plan.

 

Background

The Ride the Wave Festival is annual regional surfing, skateboarding and music festival event, held at Port Macquarie Town Beach, NSW.

The festival is held across five days and raises funds to support local charity Make a Difference PMQ in advocating for the disadvantaged and marginalised members of the community. Details of the event can be found online here: Ride The Wave Festival

Promoters expect that the 2024 event will welcome over 300 competitors for the fourth year in a row to compete in the Ride The Wave Festival Surf & Skate competition, in addition to 5000 more who will come together for the Ride The Soundwave music festival component.

The event also includes a variety of food and market stalls, as well as a range of other family-friendly activities throughout the duration of the festival.

Ride the Wave 2024 will take place from 2nd – 6th April 2024.

Traffic Management

The attached document (Traffic Management Plan for Ride the Wave Festival) details the transport management arrangements for the event including details of the proposed closure of Alban Place and associated traffic control and parking restrictions.

In particular, the traffic management plan indicates the following:

·    Four car spaces at the northern end of the Breakwall carpark will be coned off on Thursday 4 April from 8am to facilitate the safe and effective bump in of infrastructure. Local event companies, Hire Port, Coastal Hire and In Phase Productions, will undertake these works, having minimal impact to traffic and pedestrians.

·    The remainder of Alban Place will remain open to pedestrian and other road users for the duration of Thursday.

·    Further bump in of infrastructure associated with the event will occur on Friday, however no access or parking impediments are foreseen, with infrastructure bumping in being staggered and directly accessing the site via the formal vehicular access to the reserve located adjacent to the town beach amphitheatre.

·    Alban Place will be fully closed between 6am and 11pm on Saturday 6 April 2024.

On the basis that Alban Place is a Crown Reserve and not a public road reserve, a formal approval Pursuant to s138 of the Roads Act, 1993 is not required. However, given the anticipated large patronage to the event and the potential community impacts of the closure of Alban Place, this report seeks to advise the Committee of the event and associated Traffic Management Plan.

The applicant proposes that all aspects of the Traffic Management Plan and contained Traffic Guidance Scheme will be implemented and monitored by qualified traffic controllers.

Subject:     King Creek Road Temporary Closure - Bridge Replacement

RECOMMENDATION

That it be a recommendation to the Director Community Infrastructure, under sub-delegation, for implementation:

 

That Council approve the temporary closure of King Creek Road from 8 April 2024 for a period of up to 6 months to enable the construction of the upgraded King Creek Bridge. The closure is subject to the implementation of the Traffic Management Controls as outlined in this report.

 

Discussion

At the November 2023 Local Traffic Committee, Council presented a proposal to undertake a closure of King Creek Road, King Creek for a period of 6 months from 6 January 2024 to enable the upgrade of an existing bridge on King Creek.

A copy of the prior report on this matter is attached for reference and a location plan is included below:

As subsequently reported during the January 2024 meeting, Council has experienced delays associated with gaining approval to undertake a powerline relocation that was required to be undertaken prior to the commencement of the bridge replacement. This resulted in the proposed date of road closure being delayed to an unspecified date.

Following resolution of those issues, Port Macquarie - Hastings Council wish to advise the Committee that an amended date of works commencement has now been nominated, with works commencement and the closure of King Creek Road at King Creek Bridge scheduled to occur on 8 April 2024. Closure is anticipated to be in place for a period of up to 6 months.

Community Notification of Works 

In the leadup to project commencement, Variable Message Boards (VMS) will be installed in key locations along King Creek Road and Cameron St/Bago Rd for motorist information on road closure commencement, detour details and any other important updates throughout the works program.

Council’s Community Engagement team are in the process of preparing an updated resident flyer outlining the project specifics and dates to residents and businesses in the vicinity of works and have been in regular contact with emergency services, Busways and other service providers in the leadup to project commencement.

Furthermore, the community can keep up to date with the project and via our existing Fixing Country Bridges Website.  

Closures and Detours 

As previously reported, the construction phase works include the full demolition of the existing timber bridge and replacement with new bridge in the same alignment. To complete this bridge replacement safely and in a timely manner, the works must be completed under full road closure (of King Creek Road) at the bridge site.  

Due to narrow existing road corridor widths and environmentally sensitive areas on either side of the bridge crossing, a side track or temporary bridge is unable to be installed at this location. As such, a detour will be in place for the duration of the construction phase works. This detour will use Bago Road, Cameron Street and the Oxley Highway (as shown in blue below).

The prior report (November 2023) provided detail of the (then) draft Traffic Management Plan proposed to be implemented to manage the closure of King Creek Road.

In response to subsequent community concern that the closure would result in unacceptable queue lengths and traffic congestion for residents seeking to leave King Creek Road via the Oxley Hwy, Council has subsequently developed an alternate (Stage 2) Traffic Management Plan incorporating the provision of traffic control and traffic signals on the Oxley Hwy to provide better management of queueing and traffic incident risks during the AM peak period. A copy of the updated (Stage 2) traffic management plan is attached for reference.

This updated Stage 2 plan is in draft form and is currently under assessment via TfNSW as part of a ROL (road occupancy licence), however is only planned to be implemented in the instance that queue lengths for vehicles leaving King Creek Road are increased to unacceptable levels as a result to the closure.

The initial (Stage 1) Traffic Management Plan involving signage and no traffic controllers/signals will be implemented in the first instance. This is on the basis that it is considered likely that works will not result in an increase in queue lengths for vehicles exiting King Creek Road to the Oxley Hwy.

In order to ensure that an effective Traffic Management Plan and process is in place for the duration of this project, and as a means of managing community concerns, Council is presently undertaking pre-closure traffic volume and queue length monitoring and will again undertake further monitoring immediately post closure of King Creek Road. This will enable identification of and response to any undesirable traffic impacts via the implementation of the updated Stage 2 Traffic Management Plan if warranted.
