The Local Traffic Committee is formed under the NSW Roads & Traffic Authority – "A Guide to the Delegation to Councils for the Regulation of Traffic (including the operation of Traffic Committees) – November 2006"

Quorum

 

There is no need for a specific quorum to allow a Committee meeting to proceed. The advice of the Roads & Traffic Authority and the NSW Police must be sought to allow Council to exercise its delegated authority.

 

Convenor

 

The Committee shall be convened by the Council voting representative.  It shall be the responsibility of the convenor to ensure the conduct of the meeting including voting, informal advisor, public and media participation is undertaking in accordance with the RTA Guidelines.

 

Roles

 

·         To advise Council on traffic related matters referred to the Committee

·         To ensure matters referred to the Committee meets current technical guidelines

·         To ensure matters referred to the Committee for which Council has delegated authority are voted upon.

Administration

 

Council’s Technical Services Section is responsible for the co-ordination of Committee advice, scheduling of meetings, preparation and circulation of meeting minutes and providing general support services to the Committee. The Section is also responsible for providing advice in relation to the conduct of meetings.

 

Delegations

 

Council has delegations to authorise traffic control facilities and devices as prescribed  in the Delegations to Councils – Regulation of Traffic October 2001.

 

Council has sub-delegated its powers in respect of Division 1 of Part 4 of the Road Transport (Safety and Traffic Management ) Act 1999 and Division 2 of Part 5 of the Road Transport (Safety and Traffic Management ) (Road Rules) Regulation 1999 to the Director of Infrastructure Services and the Technical Services Manager.

06       Countdown to Christmas 2013 Event

CONSENSUS:

 

The committee gave unanimous support to the following conditions in relating to the Countdown to Christmas 2013 event.

 

1.       The road closure of Horton Street, from the intersection of William Street through to its northern end (north of Clarence Street) to allow a Street Parade and Fun Run(s) on Thursday 28 November 2013 from 5.30pm.

2.       The road closure of the first 20m of Horton Street (south) from the corner of William Street and Horton Street to the Turn Around Bay (north bound only) to allow the assembly of the participants in the Fun Run(s) to commence prior to the Street Parade.

3.       That the proposed road closure along Horton Street to be a rolling road closure with Horton Street to reopen once the parade passes through the Clarence Street intersection.  The northern end of Horton Street to remain closed until approximately 9.00pm (Local Traffic Committee approval granted for Northern End of Clarence Street Road Closure to remain in place at meeting held on 2/10/2013).

(Local Government Act and Code of Conduct)

 

A conflict of interest exists where a reasonable and informed person would perceive that a Council official could be influenced by a private interest when carrying out their public duty. Interests can be of two types: pecuniary or non-pecuniary.

 

All interests, whether pecuniary or non-pecuniary are required to be fully disclosed and in writing.

 

Pecuniary Interest

 

A pecuniary interest is an interest that a Council official has in a matter because of a reasonable likelihood or expectation of appreciable financial gain or loss to the Council official. (section 442)

 

A Council official will also be taken to have a pecuniary interest in a matter if that Council official’s spouse or de facto partner or a relative of the Council official or a partner or employer of the Council official, or a company or other body of which the Council official, or a nominee, partner or employer of the Council official is a member, has a pecuniary interest in the matter. (section 443)

 

The Council official must not take part in the consideration or voting on the matter and leave and be out of sight of the meeting. (section 451)

 

Non-Pecuniary

 

A non-pecuniary interest is an interest that is private or personal that the Council official has that does not amount to a pecuniary interest as defined in the Act.

 

Non-pecuniary interests commonly arise out of family, or personal relationships, or involvement in sporting, social or other cultural groups and associations and may include an interest of a financial nature.

 

The political views of a Councillor do not constitute a private interest.

 

The management of a non-pecuniary interest will depend on whether or not it is significant.

 

Non Pecuniary – Significant Interest

 

As a general rule, a non-pecuniary conflict of interest will be significant where a matter does not raise a pecuniary interest, but it involves:

(a)   A relationship between a Council official and another person that is particularly close, for example, parent, grandparent, brother, sister, uncle, aunt, nephew, niece, lineal descendant or adopted child of the Council official or of the Council official’s spouse, current or former spouse or partner, de facto or other person living in the same household.

(b)   Other relationships that are particularly close, such as friendships and business relationships. Closeness is defined by the nature of the friendship or business relationship, the frequency of contact and the duration of the friendship or relationship.

(c)   An affiliation between a Council official an organisation, sporting body, club, corporation or association that is particularly strong.

 

If a Council official declares a non-pecuniary significant interest it must be managed in one of two ways:

1.     Remove the source of the conflict, by relinquishing or divesting the interest that creates the conflict, or reallocating the conflicting duties to another Council official.

2.     Have no involvement in the matter, by taking no part in the consideration or voting on the matter and leave and be out of sight of the meeting, as if the provisions in section 451(2) apply.

If a Council official has declared a non-pecuniary less than significant interest and it does not require further action, they must provide an explanation of why they consider that the conflict does not require further action in the circumstances.

A person does not have a pecuniary interest in a matter if the interest is so remote or insignificant that it could not reasonably be regarded as likely to influence any decision the person might make in relation to the matter or if the interest is of a kind specified in section 448 of that Act (for example, an interest as an elector or as a ratepayer or person liable to pay a charge).

iii.   A pecuniary interest may arise by way of a change of permissible use of land adjoining, adjacent to or in proximity to land in which a councillor or a person, company or body referred to in section 443 (1) (b) or (c) of the Local Government Act 1993 has a proprietary interest—see section 448 (g) (ii) of the Local Government Act 1993.

Subject:     High Street, Wauchope - Transport Access Program Improvements

RECOMMENDATION

 

That the Committee:

1.   Support the implementation of a pedestrian refuge, footpath, bus shelter and associated works in High Street, Wauchope near Forest Way.

2.   Suggest modifications to the preliminary plan that should be considered at the detailed design stage.

 

 

Discussion

 

Transport for NSW, as part of the Transport Access Program, has proposed a number of improvements for a section of High Street, Wauchope opposite Forest Way. The program is a NSW Government initiative to provide a better experience for public transport customers by delivering accessible, modern, secure and integrated transport infrastructure.

 

Bus stops exist on the southern side of High Street adjacent to Timbertown and on the eastern side of Forest Way adjacent to the neighbourhood shopping centre. Busways service 335W currently proceeds westwards along High Street before turning right into Forest Way, looping around Colonial Circuit then turning left into High Street proceeding back to Wauchope town centre. Tourist coaches servicing Timbertown use a separate off-street parking area within the Timbertown site.

 

The bus stop on the southern side of High Street is used by the occasional school service but the main school bus transfer location is some 500m to the east.

 

High Street, which is a section of the Oxley Highway, is a State Road. High Street east of Forest Way has an AADT of approximately 4,500 with 7% heavy vehicles. The posted speed limit is 50km/h. Photos of the existing conditions are attached.

 

Transport for NSW’s design consultant, GHD, undertook a preliminary scoping study in 2012. Council has further developed the preliminary designs as described in this report.

 

A preliminary plan of the works has been developed as attached. The proposed works include:

 

·    Paved bus stop waiting area

·    Paved road shoulder and repaving a section of the road

·    New bus shelter

·    New pedestrian refuge

·    New footpath connections

 

The preliminary plan is subject to detailed survey and design, pavement design confirmation, utility adjustment investigations and consultation with adjoining land owner (Timbertown).

 

Council requests that the Local Traffic Committee review the preliminary plan and:

 

1.   Support or reject the overall concept;

2.   Suggest modifications that should be considered at the detailed design stage.

That the Committee support the closure of the northern end of Horton Street, north of Clarence Street  on Sunday, 26 January 2014, to allow the holding of the Australia Day event subject to the following conditions:

1.       The event organisers obtain NSW Police approval.

2.       The proposed road closure be advertised in the local print media for a period of not less than seven (7) days advising of the time and duration of the event.

3.       The event organiser notify the NSW Ambulance, NSW Fire and the State Emergency Services of the proposed road closure.

4.       The event organiser notifies all residents and businesses directly affected by the proposed road closure.

5.       The event organiser notifies local Transport Services (Bus Companies, Taxis) of the proposed road closure.

6.       The event organiser abides by any other condition that the Police may impose.

7.       An RMS Accredited (Yellow card) person is to be used for the set up/down of barricades.

8.       Qualified Traffic Controllers (RMS-Blue or Grey Card) are to be used to control traffic.

 

 

Discussion

 

Port Macquarie Hastings Council in association with the Australia Day subcommittee is coordinating the annual Australia Day festivities on Sunday, 26 January 2014. The annual event includes market and food stalls as well as other activities. To accommodate this event it is requested that the northern end of Horton Street north of Clarence Street be closed from 6:00am to 6:00pm.

RECOMMENDATION

 

1.       That the Transport Management Plans (TMP's), submitted with the events application be endorsed.

2.       That the event organiser be responsible for the implementation of the TMP's as submitted with the application.

3.       That the event organiser obtain, prior to the running of the events, the written approval of the NSW Police.

4.       The event organiser notify local Transport Services (Bus Companies, Taxis) of the proposed road closures.

5.       That the public be notified of the events through Council's Public Notices issued through local newspapers.

6.       RMS Accredited (Yellow card) personnel are to be used for the set up/down of barricades.

7.       RMS accredited (Blue card) personnel are to be used to control traffic.

8.       That the event organiser carry out a letter box drop to affected residents and business proprietors advising of the proposed partial road closures.

9.       The event organiser submit to Council prior to the commencement of the event evidence of Public Liability Insurance which is valid for the duration of the set-up, running and pull down of the event.

10.     The event organiser notify the NSW Ambulance, NSW Fire and the State Emergency Services of the proposed partial road closures.

11.     The event organiser abide by any other condition that Council, Roads and Traffic Authority and the Police may impose.

 

 

Discussion

 

The Port Macquarie Cycle Club hosts their road racing program on Burrawan Forest Drive, 15km west of Port Macquarie, starting on 1 April 2014 and running until the end of the year.

There are no proposed road closures for the listed events, however the event organiser proposes the use of authorised traffic controllers to control traffic movement at some locations in accordance with the traffic management plans as submitted.

A copy of the traffic management plan is attached for the Committee's information.

That the Committee support  the  closure of the northern end of Horton Street, Port Macquarie  on Saturday, 22 February 2014, to enable the holding of the annual Coaster's Hot Rod Run, subject to the following conditions:

1.       The event organisers obtain NSW Police approval.

2.       The event organiser submit to Council prior to the commencement of the event evidence of Public Liability Insurance which is valid for the duration of the set-up, running and pull down of the event.

3.       The proposed road closures be advertised in the local print media for a period of not less than seven (7) days advising of the time and duration of the event.

4.       The event organiser notify the NSW Ambulance, NSW Fire and the State Emergency Services of the proposed road closure.

5.       The event organiser notify local Transport Services (Bus Companies, Taxis) of the proposed road closure.

6.       The event organiser notify businesses in the Town Green precinct of the proposed closure.

7.       The event organisers provide a Traffic Management Plan for a Class 2 Special Event.

8.       The event organiser abide by any other condition that Council and the Police may impose.

9.       An RMS accredited (Yellow card) person is to be used for the set up/down of barricades.

10.     Qualified Traffic Controllers (RMS-Blue or Grey Card) are to be used to control traffic.

 

 

Discussion

 

The Coaster’s Hot Rod Club are requesting the closure of the Town Green parking area at the northern end of Horton Street from noon to 7.30pm on Saturday 22 February 2014. The event is scheduled to begin at 5:30pm.

 

The Annual Rod Run event has been conducted within the Town Green area for the past eleven years. The event will run as in previous years as per the attached  application and Traffic Control Plan. The local SES will coordinate the road closures of Horton Street on the northern side of Clarence Street as well as conducting the traffic control during the event.

RECOMMENDATION

 

That the Committee give support for Council to submit a formal application to RMS for the implementation of a 40km/h High Pedestrian Activity Zone in Bold Street, Laurieton.

 

 

Discussion

 

It is proposed to implement a 40km/h High Pedestrian Activity Zone in Bold Street, Laurieton between Tunis Street and Laurie Street. The reduced speed limit will reinforce traffic calming works that have been constructed over the last decade.

 

Bold Street is a local non-classified road. The proposal was initiated in response to several resident and local business concerns to the safety of pedestrians crossing Bold Street. Consultations have been limited to internal staff, RMS and NSW Police.

 

The works proposed to create the zone essentially involve pavement markings and signage. Bold Street currently has one marked pedestrian crossing, a number of pedestrian refuges and angle parking. The existing road environment produces low speeds and therefore no additional LATM works are required.

 

The proposal meets the criteria of the applicable RMS guidelines (40 km/h speed limits in high volume pedestrian areas). In particular the Bold Street location:

 

·    Has high pedestrian volumes, including a high proportion of elderly pedestrians

·    Services a business or commercial area

·    Is adjacent to a bus interchange

·    Services a small shopping strip less than 1km

·    Services a restaurant and hotel area

·    Is adjacent to a number of medical centres

 

Bold Street, from midway between Seymour Street and Laurie Street to midway between Laurie Street and Mill Street, is a 40km/h school zone. This will need to be taken into consideration when the engineering works plan is developed.

Discussion

Attached is the updated Status Report for all incomplete traffic matters relating to Traffic Facilities considered by this Committee and resolved by Council.  The Status Report is provided for information of all Committee members and to assist in finalising their actions to ensure that all items are completed as soon as possible.
