The Local Traffic Committee is formed under the NSW Roads & Traffic Authority – "A Guide to the Delegation to Councils for the Regulation of Traffic (including the operation of Traffic Committees) – November 2006"

Quorum

 

There is no need for a specific quorum to allow a Committee meeting to proceed. The advice of the Roads & Traffic Authority and the NSW Police must be sought to allow Council to exercise its delegated authority.

 

Convenor

 

The Committee shall be convened by the Council voting representative.  It shall be the responsibility of the convenor to ensure the conduct of the meeting including voting, informal advisor, public and media participation is undertaking in accordance with the RTA Guidelines.

 

Roles

·         To ensure matters referred to the Committee meets current technical guidelines

·         To ensure matters referred to the Committee for which Council has delegated authority are voted upon.

Administration

 

Council’s Transport and Stormwater Network Section is responsible for the co-ordination of Committee advice, scheduling of meetings, preparation and circulation of meeting minutes and providing general support services to the Committee. The Section is also responsible for providing advice in relation to the conduct of meetings.

 

Delegations

 

Council has delegations to authorise traffic control facilities and devices as prescribed  in the Delegations to Councils – Regulation of Traffic October 2001.

 

Council has sub-delegated its powers in respect of Division 1 of Part 4 of the Road Transport (Safety and Traffic Management ) Act 1999 and Division 2 of Part 5 of the Road Transport (Safety and Traffic Management ) (Road Rules) Regulation 1999 to the Director of Infrastructure Services and the Technical Services Manager.

04      DISCLOSURES OF INTEREST

05       High Street, Wauchope - Transport Access Program Improvements

Council Traffic Engineer (John Hanlon) discussed the following items in relation to this report.

1.         The request was instigated by Transport NSW and relates to their Transport Access Programme.

2.         It is 100% funded by Transport NSW.

3.         The bus interchange and bus shelter location were specified by Transport NSW

4.         Communications with Transport NSW has only been at officer level and Transport NSW have declined the suggestion of relocating the bus interchange to a location within the Wauchope CBD that is of a higher priority to Council.

Meeting discussion summary;

1.         The location of the shelter was questioned

2.         Only one bus route is catered for, at this location

3.         Wauchope CBD bus interchange is a higher priority for Council

4.         A refuge at this location would be an advantage but a bus shelter is not warranted.

5.         The road condition is poor at this location.

CONSENSUS:

 

The Committee gave majority support to the following:

1.   Council to seek further advice from Transport NSW for this funding to be reallocated for Wauchope CBD Public Transport Infrastructure.

2.   The advice is to note, RMS is concerned that a bus shelter is not warranted at this location.

06       Australia Day Celebrations 2014 - Horton Street, Port Macquarie

CONSENSUS:

 

The Committee gave unanimous support to the closure of the northern end of Horton Street, north of Clarence Street  on Sunday, 26 January 2014, to allow the holding of the Australia Day event subject to the following conditions:

1.       The event organisers obtain NSW Police approval.

2.       The proposed road closure be advertised in the local print media for a period of not less than seven (7) days advising of the time and duration of the event.

3.       The event organiser notify the NSW Ambulance, NSW Fire and the State Emergency Services of the proposed road closure.

4.       The event organiser notifies all residents and businesses directly affected by the proposed road closure.

5.       The event organiser notifies local Transport Services (Bus Companies, Taxis) of the proposed road closure.

6.       The event organiser abides by any other condition that the Police may impose.

7.       An RMS Accredited (Yellow card) person is to be used for the set up/down of barricades.

8.       Qualified Traffic Controllers (RMS-Blue or Grey Card) are to be used to control traffic.

07       NSW Cycling Federation 2014 Road Race Season - Port Macquarie

CONSENSUS:

 

The committee gave unanimous support for the NSW Cycling Federation 2014 Road Race Season in Port Macquarie subject to the following conditions.

 

1.       That the Transport Management Plans (TMP's), submitted with the events application be endorsed.

2.       That the event organiser be responsible for the implementation of the TMP's as submitted with the application.

3.       That the event organiser obtain, prior to the running of the events, the written approval of the NSW Police.

4.       The event organiser notify local Transport Services (Bus Companies, Taxis) of the proposed road closures.

5.       That the public be notified of the events through Council's Public Notices issued through local newspapers.

6.       RMS Accredited (Yellow card) personnel are to be used for the set up/down of barricades.

7.       RMS accredited (Blue card) personnel are to be used to control traffic.

8.       That the event organiser carry out a letter box drop to affected residents and business proprietors advising of the proposed partial road closures.

9.       The event organiser submit to Council prior to the commencement of the event evidence of Public Liability Insurance which is valid for the duration of the set-up, running and pull down of the event.

10.     The event organiser notify the NSW Ambulance, NSW Fire and the State Emergency Services of the proposed partial road closures.

11.     The event organiser abide by any other condition that Council, Roads and Traffic Authority and the Police may impose.

08       Coasters Hot Rod Run - 22 February 2014

 

CONSENSUS:

 

The committee gave unanimous support to the closure of the northern end of Horton Street, Port Macquarie  on Saturday, 22 February 2014, to enable the holding of the annual Coaster's Hot Rod Run, subject to the following conditions:

 

1.       The event organisers obtain NSW Police approval.

2.       The event organiser submit to Council prior to the commencement of the event evidence of Public Liability Insurance which is valid for the duration of the set-up, running and pull down of the event.

3.       The proposed road closures be advertised in the local print media for a period of not less than seven (7) days advising of the time and duration of the event.

4.       The event organiser notify the NSW Ambulance, NSW Fire and the State Emergency Services of the proposed road closure.

5.       The event organiser notify local Transport Services (Bus Companies, Taxis) of the proposed road closure.

6.       The event organiser notify businesses in the Town Green precinct of the proposed closure.

7.       The event organisers provide a Traffic Management Plan for a Class 2 Special Event.

8.       The event organiser abide by any other condition that Council and the Police may impose.

11       GENERAL BUSINESS

 

11.01 Speeding Vehicles In Blueberry Lane:

 

NSW Police representative (Grant Christensen) tabled a letter from a Mr B Dowse, in

relation to a complaint about drivers speeding along Blueberry Lane and Aston Street Port

Macquarie as well as a proposal to make Blueberry Lane a one way Street.

 

Council Administration Officer (Philip Marshall) indicated Council had completed a study on a proposal for one way traffic flow in Blueberry Lane. On the 20th September 2012 Council updated residents who had made a submission with the following;

 

“Council received 18 written submissions with 10 objecting to the proposal and 8 supporting the proposal subject to conditions.

The proposal was further reviewed in terms of the traffic safety and efficiency improvements and it is considered the limited benefits gained, together with the absence

of any recorded accidents are not sufficient to warrant the one way proposal at this stage.”

A conflict of interest exists where a reasonable and informed person would perceive that a Council official could be influenced by a private interest when carrying out their public duty. Interests can be of two types: pecuniary or non-pecuniary.

 

All interests, whether pecuniary or non-pecuniary are required to be fully disclosed and in writing.

 

Pecuniary Interest

 

A pecuniary interest is an interest that a Council official has in a matter because of a reasonable likelihood or expectation of appreciable financial gain or loss to the Council official. (section 442)

 

A Council official will also be taken to have a pecuniary interest in a matter if that Council official’s spouse or de facto partner or a relative of the Council official or a partner or employer of the Council official, or a company or other body of which the Council official, or a nominee, partner or employer of the Council official is a member, has a pecuniary interest in the matter. (section 443)

 

The Council official must not take part in the consideration or voting on the matter and leave and be out of sight of the meeting. (section 451)

 

Non-Pecuniary

 

A non-pecuniary interest is an interest that is private or personal that the Council official has that does not amount to a pecuniary interest as defined in the Act.

 

Non-pecuniary interests commonly arise out of family, or personal relationships, or involvement in sporting, social or other cultural groups and associations and may include an interest of a financial nature.

 

The political views of a Councillor do not constitute a private interest.

 

The management of a non-pecuniary interest will depend on whether or not it is significant.

 

Non Pecuniary – Significant Interest

 

As a general rule, a non-pecuniary conflict of interest will be significant where a matter does not raise a pecuniary interest, but it involves:

(a)   A relationship between a Council official and another person that is particularly close, for example, parent, grandparent, brother, sister, uncle, aunt, nephew, niece, lineal descendant or adopted child of the Council official or of the Council official’s spouse, current or former spouse or partner, de facto or other person living in the same household.

(b)   Other relationships that are particularly close, such as friendships and business relationships. Closeness is defined by the nature of the friendship or business relationship, the frequency of contact and the duration of the friendship or relationship.

(c)   An affiliation between a Council official an organisation, sporting body, club, corporation or association that is particularly strong.

 

If a Council official declares a non-pecuniary significant interest it must be managed in one of two ways:

1.     Remove the source of the conflict, by relinquishing or divesting the interest that creates the conflict, or reallocating the conflicting duties to another Council official.

2.     Have no involvement in the matter, by taking no part in the consideration or voting on the matter and leave and be out of sight of the meeting, as if the provisions in section 451(2) apply.

If a Council official has declared a non-pecuniary less than significant interest and it does not require further action, they must provide an explanation of why they consider that the conflict does not require further action in the circumstances.

A person does not have a pecuniary interest in a matter if the interest is so remote or insignificant that it could not reasonably be regarded as likely to influence any decision the person might make in relation to the matter or if the interest is of a kind specified in section 448 of that Act (for example, an interest as an elector or as a ratepayer or person liable to pay a charge).

iii.   A pecuniary interest may arise by way of a change of permissible use of land adjoining, adjacent to or in proximity to land in which a councillor or a person, company or body referred to in section 443 (1) (b) or (c) of the Local Government Act 1993 has a proprietary interest—see section 448 (g) (ii) of the Local Government Act 1993.

That  the temporary partial closure of Hay and Clarence Streets, Port Macquarie as detailed in this report be supported to enable the graduation parade from noon to 12:20pm on Friday, 28 February 2014 to proceed, subject to the following conditions:

1.       The event organisers obtain NSW Police approval.

2.       The event organiser submit to Council prior to the commencement of the event evidence of Public Liability Insurance which is valid for the duration of the set-up, running and pull down of the event.

3.       The proposed road closure be advertised in the local print media for a period of not less than seven (7) days advising of the time and duration of the event.

4.       The event organiser notify the NSW Ambulance, NSW Fire and the State Emergency Services of the proposed road closures.

5.       The event organiser notify local Transport Services (Bus Companies, Taxis) of the proposed road closures.

Discussion

 

As part of the University of Newcastle graduation ceremony at the Glasshouse on Friday 28 February 2014 the University is requesting that all the participants parade from the Town Green along Hay Street across Clarence Street to the Glasshouse. The procession would begin at noon and conclude at 12:20pm and would involve a maximum of 100 people.

Subject:     2014 NSW Junior State Touch Football Championships

RECOMMENDATION

 

That the committee support the Transport Management Plan to accommodate the holding of the NSW Junior State Touch Football Championships on 15-16 February, 2014 in Port Macquarie, subject to the following conditions:

1.       That the event be categorised as a Class 2 special event.

2.       That the event organisers obtain written approval from the NSW Police.

3.       That the event organiser carries out a letter-box drop to affected residents and businesses advising of the proposed traffic management arrangements.

4.       That the event organiser submit to Council prior to the commencement of the event evidence of Public Liability Insurance which is valid for the duration of the set-up, running and pull down of the event.

5.       That the proposed traffic management arrangements be advertised in the local print media for a period of not less than fourteen (14) days advising of the time and duration of the event and the traffic management arrangements.

6.       That the event organiser notify the NSW Ambulance, NSW Fire and the State Emergency Services of the proposed traffic management arrangements.

7.       That the event organiser notifies local Transport Services (Bus Companies, Taxis and Airport) of the proposed traffic management arrangements.

8.       Controlled access for scheduled bus services is to be permitted and maintained.

9.       That the event organiser complies with all the conditions identified in the Transport Management Plan.

10.     RMS accredited personnel (Yellow card) are required to set up and work with Traffic Control Plans at the site.

11.     RMS accredited Traffic Controllers (Blue or Grey card) are to be used for the control of traffic.

12.     That the event organiser abides by any other condition that Council and the Police may impose.

13.     That a review of the implementation of the TMP be undertaken by the proponent in consultation with Council and other services following the event so that the TMP can be further refined and any issues identified can be addressed prior to any future events.

 

 

Discussion

 

The NSW Junior State Touch Football Championships is an annual event held in the Regional Stadium / Tuffins Lane sporting precinct of Port Macquarie. The 2014 event will be held on the weekend of 15-16 February 2014.

 

It is expected the event will have in the order of 320 teams which may translate into a total of over 16,000 people involved including players, spectators, volunteers and officials. The majority of these people will travel to Port Macquarie from all parts of NSW.

 

The attached Transport Management Plan (TMP) details arrangements for the transporting of people to and from the site precinct. Minor changes to this document have been requested. These changes have not been received in time for the issue of this report and a revised TMP is expected to be received on or before the 05 February 2014. Subject:     Laurieton Public School P & C Street Markets 2014

RECOMMENDATION

 

That the partial road closure of Bold and Seymour Streets, Laurieton on Saturday, 19 April and Monday, 6 October 2014 from 6:00am to 2:00pm, to allow the running of the annual Laurieton Street Markets, be supported subject to the following conditions:

1.       The event organisers obtain NSW Police approval.

2.       The event organiser submit to Council prior to the commencement of the event evidence of Public Liability Insurance which is valid for the duration of the set-up, running and pull down of the event.

3.       The proposed road closure be advertised in the local print media for a period of not less than seven (7) days advising of the time and duration of the event.

4.       The event organiser notify the NSW Ambulance, NSW Fire and the State Emergency Services of the proposed road closure.
5.  The event organiser notify local Transport Services (Bus Companies, Taxis) of the proposed road closure.

6.       The event organiser notify local businesses affected by the proposed road closures

7.       The event organiser abide by any other condition that Council and the Police may impose.

8.       RMS yellow card qualified personnel are to be used for the set up/down of barricades.

9.       RMS blue card qualified personnel are to be used to control traffic at intersections.

 

 

Discussion

 

Laurieton Public School Parents & Citizens Association have applied to Council to conduct their annual street markets on Saturday, 19 April and Monday, 6 October 2014.  The proposed road closures are for Bold and Seymour Streets, Laurieton. The closures are required  from 6:00am to 2:00pm.

 

This event has been run for several years with previous support of the Committee.

 

Please find attached the Traffic Management Plan submitted by the Laurieton Primary School P&C Association.

Discussion

Attached is the updated Status Report for all incomplete traffic matters relating to Traffic Facilities considered by this Committee and resolved by Council.  The Status Report is provided for information of all Committee members and to assist in finalising their actions to ensure that all items are completed as soon as possible.
